Terms and conditions
KLAUT (Pty) Ltd — online and office sales
Version T-DRAFT-1. You can print or save this page for your records.
1. Who we are and how a contract is made
These terms apply to every sale by KLAUT (Pty) Ltd ("KLAUT"). For custom work, a contract is made when you accept a specific version of our quote; for online orders, when you confirm the order at checkout. We keep a record of the terms version you accepted, when, and by whom.
2. Prices and payment
- Prices are in South African rand and are those shown on the accepted quote or at checkout. Quotes are valid for the period stated on them.
- Stock (buy-now) items are paid in full when you order.
- Custom and decorated orders need a deposit of 55 % before production starts. Where you supply the garments, the deposit is 100 % of the decoration value. The balance is invoiced after proof approval and is payable before dispatch or collection, unless you have approved credit terms.
- Credit terms (14 or 30 days) are given only by written agreement. We do not charge interest on late payments; overdue accounts receive reminders and credit terms may be suspended.
3. Cancellation and deposits
- If you cancel after accepting a quote or confirming a custom order, the deposit is kept. Amounts paid above the deposit are refunded, less costs already incurred, with a credit note.
- This rule is under attorney review (CPA s17 requires cancellation charges to be reasonable) and may be replaced by a staged schedule before launch.
- Your right to cancel online purchases of standard goods within 7 days is set out in our returns policy.
4. Artwork and proofs
- Nothing decorated is produced until you approve a proof and the deposit is paid. Please check spelling, names, numbers, sizes, colours and placement carefully: the approved proof is what we make.
- 2 proof revisions are included; further changes may be charged at our design rate.
- You confirm that you own or are licensed to use any logo, design or text you supply. We decline work that infringes someone else's rights.
5. Colour and finish
Screens, printers, thread and fabric show colour differently. Colours are matched as closely as practical; small differences between the proof, samples and finished goods, and between production batches, are within normal tolerance and are not a defect.
6. Garments you supply
When you supply the garments (COG), we are responsible for the decoration only. We are not liable for defects in the garment itself, or for damage caused by the garment's fibre or construction, unless caused by our negligence. Please send 2–3 % spares.
7. Lead times, delivery and collection
- Stock items: about 5 working days after payment. Custom work: about 12 working days after proof approval and deposit, or as stated on your quote. Lead times are estimates; we tell you promptly about any delay.
- Delivery is by courier to the address you give; risk passes to you on delivery. Collection is free from our workshop.
8. Quality and warranty
Our goods, including custom goods, carry the implied warranty of quality in section 56 of the Consumer Protection Act: if goods are defective (for example peeling print, failed embroidery or seams) you may return them within 6 months of delivery and choose repair, replacement or a refund. Goods that do not match the approved proof or specification may be rejected at our cost. This does not cover fair wear and tear or damage from not following the care instructions.
9. Returns
See our returns, cancellations and refunds policy, including the rule for personalised goods.
10. Privacy
We handle personal information as described in our privacy notice.
11. General
South African law applies. Nothing in these terms limits your rights under the Consumer Protection Act or the Electronic Communications and Transactions Act.
